By making use of the websites, www.turismodecanarias.com and/or www.canarias.es, the user is deemed to have fully accepted all the Terms and Conditions set out in this legal Information document, which means that the user should refrain from making use of the said websites if he does not agree with any part hereof.

The contents of this website are protected by the provisions of the relevant intellectual and industrial property laws and the rights thereto have been legally ceded for the relevant purposes by the respective owners thereof. Any reproduction, distribution, modification or publication of these contents is prohibited (and shall be prosecuted), regardless of whether such contravention relates to all or part of the information and contents that are made available on this website.

PROMOTUR provides the services referred to in these Terms of Use free of charge, without prejudice to the possibility of introducing a charge for certain of the services or products being offered, in which case the user shall be informed at the appropriate time in the sections designated for these purposes.

PROMOTUR shall not be held liability for any loss and/or prejudice of any nature which the user or a third party may suffer as a result of:

• Any failures with regard to the availability, maintenance or effective functioning of www.turismodecanarias.com and/or www.canarias.es, as well as its services or contents;
• Any failure to satisfy the needs or expectations of the user with regard to the utility, accuracy, applicability or validity of www.turismodecanarias.comand/or www.canarias.es, as well as its services or contents;

PROMOTUR will modify its current privacy policy whenever it is necessary to bring the same in line with any legislative or regulatory changes, or if it is necessary to adapt the said policy to any directives issued by the Agency for the Protection of Information. In this regard, PROMOTUR recommends that its users periodically review these policies in order to inform themselves of any changes in policy that may affect them.

The collection of such personal information, as well as the subsequent treatment and use thereof, is subject to the provisions of the legislation currently in force in Spain with regard to the protection of information, namely the Parliamentary Act on the Protection of Information of a Personal Nature, No 15/1999 of 13 December (LOPD – “Ley Orgánica de Protección de Datos de Carácter Personal”), as well as the regulations promulgated thereunder. In accordance with the provisions of the Parliamentary Act on the Protection of Information of a Personal Nature, No. 15/1999 of 13 December, PROMOTUR undertakes to comply with its obligations of secrecy with regard to the said personal information and its obligation to treat the same with due confidentiality. To this end, it will implement the necessary measures to ensure that such information is not altered, lost or exposed to unauthorised treatment or access. The levels of security adopted by PROMOTUR shall be tailored to the nature of the information supplied to us, as required in accordance with the provisions of Section 9 of Parliamentary Act No 15/1999 and Title VII of Royal Decree No. 1720/2007 of 21 December, in terms of which the regulations for the implementation of the Act on the Protection of Information of a Personal Nature, No. 15/1999 of 13 December, were promulgated. The term, providers of information society services, is defined as including any natural or juristic persons who provide the following services to members of the public:

Collection of users’ personal data on the website

PROMOTUR hereby informs its users that all information of a personal nature will be collected through the completion of forms and the entering of e-mail addresses on this website.

Users of this website are, further, advised that PROMOTUR will duly inform its users, on any forms to be completed and prior to the completion thereof, whether it is optional or compulsory to complete the said forms in their entirety.

If you do not wish PROMOTUR to obtain any of your personal information, we request you to refrain from completing any forms on the website. In any event, PROMOTUR will expressly and legibly inform you of the conditions subject to which the relevant personal information is collected, the purposes for which it will be used and whether it is obligatory or not to supply the said information, as well as all the rights of which you as user can avail yourself, the conditions in which these rights may be exercised, and any other information which you, the user, may need to know.

The treatment of personal information is defined as those operations and technical procedures, which may or may not be automated, that are performed for the purposes of collection, recording, processing, modification, blocking and cancellation; as well as any transfer of information that may result from communications, enquiries, inter-connections and transfers.

o Assessing your professional suitability for any job or jobs being applied for and enabling your participation in the selection processes carried out by PROMOTUR or the Government of the Canary Islands.

o Receiving commercial communications with special offers from PROMOTUR by e-mail.

Rights of which the user, as owner of his personal information, can avail himself:

In compliance with the provisions of Title III of Royal Decree 1720/2007 of 21 December, PROMOTUR hereby informs users who supply their personal information that they may at any time exercise their right to access and obtain the details of any information that has been collected and handled by PROMOTUR; and to rectify any information that may be incorrect, or to delete any information or object to the use thereof, the last-mentioned right being limited to those cases in which the user’s consent is not necessary for the use of such information, except insofar as the provisions of any act may stipulate the contrary, and when there are well-founded and legitimate reasons relating to the user’s specific personal situation, or when his personal information is used for publicity purposes or market research.

The user can exercise these rights by addressing a written communication, accompanied by a photocopy of his national identity document, or any other legally valid form of identification, to the following address:

The communication in question shall contain the following information:
1. Name and surname of the user;
2. Specific request being made;
3. Address for the purposes of notifications, as well as the date and signature of the user; and

PROMOTUR hereby informs its users that the exercise of these rights is highly individual in nature, which means that only the user himself is able to exercise these rights in respect of any personal information of which he is the legal owner. Notwithstanding the above, it may be permitted, in exceptional circumstances, that the rights vesting in the user be exercised by his duly authorised representative in the manner set out above, provided that the relevant communication is accompanied by the document conferring such authorisation.

Without prejudice to the aforegoing, any objection to, or the revocation of any consent given by the user with regard to, the sending of advertising or promotional material by e-mail or any other equivalent electronic means of communication, shall be made possible for the user through simple means that is available free of charge, the user being conveniently informed in this regard at the moment in which his e-mail address is being obtained for such purposes. Security measures:
PROMOTUR warrants that it has adopted the security measures stipulated by Section 9 of the Parliamentary Act on the Protection of Information of a Personal Nature, No 15/1999, and by the regulations promulgated thereunder.

The said measures are sufficient, having regard to the current state of the technology, as well as the nature of the information being stored and the risks to which it is exposed, which risks may flow from human action or from natural or physical events, to guarantee the security of all personal information and to ensure that it is not altered, lost, or exposed to unauthorised access or use,

PROMOTUR does not record any personal information in any files which do not comply with the relevant legislative requirements regarding integrity and security; regardless of whether these files are kept at its operations centre or premises, or stored in its equipment, systems or software.

If any third party companies should obtain access to the user’s personal information for the purposes of providing a service to PROMOTUR, PROMOTUR similarly guarantees users that the contracts for the provision of the relevant services which PROMOTUR concludes with the said companies, will contain provisions stipulating the security measures which the said third party companies will be required to implement according to the nature of the information to which they gain access and in compliance with the Parliamentary Act on the Protection of Information of a Personal Nature and the regulations promulgated thereunder.

All user names and passwords which PROMOTUR may make available to the user on the website for the purposes of accessing and/or using any particular services or contents on the website, are confidential, secret, personal and non-transferable and are to be used for the purposes of accessing and/or enjoying the said services or contents.

Any services or contents which require prior user-verification through entry of the user name and password may be blocked by PROMOTUR if there should be 5 successive mistakes in the entry of the password. However, PROMOTUR may change the maximum number of incorrect attempts by prior notification of user. The user name and password shall only be unblocked if PROMOTUR has been able to satisfactorily verify the user’s identity.

After the unblocking of the user’s account, a new password will be supplied.

The user is responsible for the confidentiality of his password and may not, in any circumstances, disclose the same to any third parties and he must refrain from recording it in any medium of whatsoever nature, which could facilitate the discovery thereof by third parties.

If the user’s password should become known to unauthorised third parties through chance or fraud, or if any other events should occur which could compromise the confidentiality of the said password, the user shall immediately inform PROMOTUR thereof by telephone, ordinary post or e-mail.

All Users of www.turismodecanarias.com and/or www.canarias.es expressly waive their right to any jurisdiction to which they may be entitled, without prejudice to any judicial powers which may be conferred by the law, and they hereby submit themselves to the jurisdiction of the Courts and Tribunals of Las Palmas de Gran Canaria for the resolution of any disputes which may arise with regard to the interpretation, application and fulfilment of these Terms of Use, as well as the resolution of any claims that may derive from the use of the said website.
